WHEREIN, SASSINC.Net provides space and transfer services over the internet.

WHEREIN, the Customer wishes to utilize SASSINC.Net’s server(s) for its own purposes.

WHEREIN all parties acknowledge that the internet is neither owned or controlled by any one party.

SASSINC.Net represents that it will make every good faith effort possible to ensure that its servers are available as widely as possible with as little service interruption as possible.

THEREFORE in consideration of the mutual promises contained herein, all parties agree as follows:

FINANCIAL AGREEMENTS

1. Customer is aware the they are entitled to our 30-Day Money Back Guarantee.  If at anytime within the first thirty (30) days after signing up for any of our plans, you are dissatisfied, you may request a full refund of the amount of the plan you purchased.
2. Customer is aware that we do not charge any setup fee for any of our plans.  Setup is absolutely free.
3. Customer agrees to pay in full the amount due for whatever plan was purchased.

TAXES

SASSINC.Net is not liable for any taxes, Federal or State, for services rendered.  Customer agrees that any taxes due for any activity within the customers account, is the responsibility of said customer.

PRODUCTS and/or MATERIAL

SASSINC.Net makes no warranties or representations of any kind that any material you place on our services, will function in the manner inwhich you feel they should.  It is the Customers responsibility to ensure that said material functions correctly.  SASSINC.Net will, however; do whatever is in its power to assist its Customers.

Customer agrees to use SASSINC.Net services primarily for web hosting, email functions and associated functions. IRC, CGI chat rooms and other poorly coded applications are not permitted. This is a shared environment, therefore the good of the whole comes before one customer.

BANNED CONTENT

SASSINC.Net reserves the right to ban any material/content, at any time. The following items are specifically not permitted on our servers:

1. Child Pornography
2. Hateful content geared toward any race or religion
3. The trading of or access to any stolen credit card numbers
4. Any material deemed illegal in the USA

SASSINC.Net reserves the right to delete any account that has any of the above in it.  Any account deleted for such, will not be eligible for a refund.

BANNED APPLICATIONS

SASSINC.Net reserves the right to ban any application from its servers that we feel uses too much of the servers resources, such as:

1. CGI based Chat Room applications (JAVA Chat applications are OK)
2. ADSphp
3. Any IRC application
4. CGI based Forum applications (PHP Forum applications are OK)
5. Matt’s FormMail CGI script - all versions

SASSINC.Net reserves the right to determine if an application is causing resource issues, and in the extreme, pull said application from server.

COPYRIGHTS and TRADEMARKS

Customer warrants that it has the right to use the applicable trademarks, if any.

EQUIPMENT and SOFTWARE

Customer is responsible for all telephone, computer, hardware and software necessary to access SASSINC.Net.

SASSINC.Net makes no representations or warranties that said customers equipment will be compatible with SASSINC.Net services.

AGE

The Customer certifies that he or she is of at least 18 years of age, or a parent or legal guardian will act as the customer in terms of this contract.

TERMINATION

This contract may be terminated by either party, without cause, by giving the other party thirty (30) days written notice (except in the case of our 30 Day Money Back Guarantee).  SASSINC.Net will accept electronic mail for the above.  SASSINC.Net may terminate service under this contract at any time, without penalty, if the customer fails to comply with the terms of this contract, including nonpayment.

LIMITED LIABILITY

1. Customer expressly agrees that the use of SASSINC.Net’s server(s) is at the Customers own risk.  Neither SASSINC.Net Internet Services, Systems and Software Solutions, Inc. (SASSINC), its employees, affiliates, agents, third party information providers, or the like, warrant that service will be error free; nor do they make any warranty as to the results that may be obtained from the use of our services or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through SASSINC.Net Internet Services, unless otherwise expressly stated in this contract.
2. Under no circumstance, including negligence, shall SASSINC.Net Internet Services, its offices, agents or anyone else involved in creating, producing or distributing SASSINC.Net Internet Services be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the SASSINC.Net Internet Services services; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to SASSINC.Net Internet Services records, programs or services.  Customer hereby acknowledges that this paragraph applies to all content on SASSINC.Net Internet Services servers.
3. Customer agrees that exclusive remedies for all damages, losses and causes of action whether in contract, tort including negligence or otherwise, will not exceed the aggregate amount which Customer paid during the term of this contract and any reasonable legal fee and court costs.

LAWFUL PURPOSE

Customer agrees to only use SASSINC.Net Internet Services servers for lawful purposes. Transmission of any material in violation of any Country, Federal, State or Local regulation is strictly prohibited. To this effect, child pornography is strictly prohibited as well as housing any copyrighted information or material on SASSINC.Net Internet Services servers for the purpose of illegal distribution or infringement.

Customer further agrees not to have or hold any content on their site that advocates, sells or in any way makes available tools or methods to send unsolicited email or Usenet postings (spam), or to use SASSINC.Net Internet Services servers for relaying unsolicited email or Usenet postings, or to use unsolicited email or Usenet postings to advertise for their site hosted at SASSINC.Net. 

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold SASSINC.Net Internet Services harmless from any and all demands, liabilities, losses, costs and claims, including attorney fees, (“Liabilities”) asserted against SASSINC.Net Internet Services, Systems and Software Solutions, Inc. (SASSINC), its agents, its customers, servants, officers and employees, that may arise or result from any service or product provided or performed or agreed to be performed or any product sold by Customer, its agents, employees or assigns.  Customer agrees to defend, indemnify and hold harmless SASSINC.Net Internet Services against Liabilities arising out of:

• any injury to person or property caused by any products sold or otherwise distributed in connection with SASSINC.Net Internet Services;
• any material supplied by Customer infringing or allegedly infringing on the proprietary rights of a third party;
• copyright infringement;
• any defective product which Customer sold on SASSINC.Net Internet Services server(s).

CONTRACT REVISIONS

Revisions to this Contract will be applicable to previous Contracts.

Revisions will be considered agreed to by the Customer on renewal of service.

TRANSFER of CONTRACT

Customer may not transfer this contract without the written consent of SASSINC.Net Internet Services.

CONTRACT

These Terms and Conditions constitutes the entire Contract and understanding of the parties.

Any changes or modifications to these Terms and Conditions of Contract thereto are agreed to by both parties upon renewal of service.
